IMPORTANT NOTICE
Welcome to Always Trying Racing Syndicate.
Our aim is to provide affordable, enjoyable and professional racehorse ownership for members of all experience levels. Whether you're joining your very first syndicate or have years of racing experience, we are committed to making ownership exciting, rewarding and accessible.
Membership gives you the opportunity to experience the thrill of racehorse ownership through race days, stable visits, regular updates and exclusive behind-the-scenes access as you follow our horses throughout their racing careers.
Whilst success on the racecourse may result in prize money, membership should always be entered into for enjoyment rather than financial gain. Horse racing is an unpredictable sport, and no guarantees can be given regarding a horse's performance, future success or financial return.
By purchasing, renewing or continuing your membership with Always Trying Racing Syndicate, you confirm that you have read, understood and agree to be bound by these Membership Terms & Conditions.
1. DEFINITIONS
Throughout these Terms & Conditions the following definitions apply:
"Always Trying Racing Syndicate" ("the Syndicate") means the racehorse syndicate operated by Neville King.
"The Syndicator" means Neville King, who is responsible for the day-to-day management and administration of the Syndicate.
"The Company" means Always Trying Racing Syndicate.
"Member" means any individual whose application has been accepted and whose membership subscription has been successfully paid.
"Horse" means any racehorse owned, leased or managed by Always Trying Racing Syndicate for the benefit of its members.
"Annual Membership" means a fixed annual membership relating to a specific horse, such as Faithful Guardian.
"Lease Share Membership" means a monthly subscription providing members with participation in a leased racehorse, including entitlement to qualifying prize money but no ownership of the horse.
"Prize Money" means any prize money distributed by the Syndicate after deductions required under these Terms & Conditions.
"British Horseracing Authority (BHA)" means the governing body responsible for the Rules of Racing in Great Britain.
2. MEMBERSHIP
Membership is offered solely at the discretion of Always Trying Racing Syndicate.
Submitting an application or making payment does not automatically guarantee acceptance into the Syndicate.
Membership becomes active only once:
- Your application has been accepted.
- Payment has been successfully received.
- Confirmation of membership has been issued.
Membership benefits apply only whilst a membership remains active and fully paid.
Always Trying Racing Syndicate reserves the right to refuse or terminate membership where a member breaches these Terms & Conditions or behaves in a manner considered detrimental to the Syndicate, its members, trainers or reputation.
3. MEMBERSHIP TYPES
Always Trying Racing Syndicate currently offers two different types of membership.
Annual Memberships
Annual Memberships relate to designated horses offered on an annual basis.
These memberships:
- are paid annually;
- are non-refundable once purchased;
- remain valid for the published membership period;
- include the benefits advertised for that particular horse.
Unless otherwise stated, Annual Memberships do not automatically renew.
Monthly Lease Share Memberships
Lease Share Memberships operate on a monthly subscription.
These memberships provide members with the opportunity to enjoy racehorse ownership without purchasing an ownership interest in the horse itself.
Members receive the benefits advertised for that particular horse whilst their subscription remains active.
Lease Share Memberships may be cancelled at any time by the member.
Cancellation immediately ends all membership rights and benefits associated with that horse, including eligibility for future prize money, race day invitations, stable visits and member-exclusive benefits from the date the cancellation takes effect.
Lease Share Membership does not provide legal ownership of the horse or any entitlement to proceeds arising from the future sale of the horse.
4. PAYMENTS
Membership fees are payable in accordance with the pricing published on the Always Trying Racing Syndicate website at the time of joining.
Failure to make any scheduled payment may result in suspension or cancellation of membership without notice.
Where membership is cancelled due to non-payment, Always Trying Racing Syndicate reserves the right to withdraw all associated benefits until payments are brought fully up to date.
Membership prices may be reviewed periodically.
Any future pricing changes will apply only to new memberships or renewal periods unless otherwise advised.
5. MANAGEMENT OF THE HORSES
Always Trying Racing Syndicate is responsible for the management of all horses within the Syndicate.
All decisions relating to the purchase, leasing, training, racing, veterinary treatment, rehabilitation, retirement or sale of any horse shall be made by the Syndicator in consultation with the relevant trainer, owner or professional advisers where appropriate.
These decisions are made in the best interests of both the horse and the Syndicate.
Members acknowledge that horse racing is an unpredictable sport and that no guarantees can be given regarding a horse's performance, race entries, success, fitness or racing career.
The Syndicate reserves the right to change a horse's trainer, ownership arrangements, race programme or management whenever considered appropriate.
6. PRIZE MONEY
Prize money received by the Syndicate will be distributed only where this forms part of the advertised membership benefits for the relevant horse.
For Lease Share Memberships, members may receive a share of qualifying prize money after the deduction of any costs, taxes or charges applicable to the Syndicate.
Lease Share Memberships do not provide members with any ownership interest in the horse.
Accordingly, Lease Share Members have no entitlement whatsoever to any proceeds arising from the future sale, transfer or disposal of the horse.
Members whose subscriptions have been cancelled, expired or terminated before prize money is distributed shall not be entitled to receive any future prize money.
The Syndicator's decision regarding the calculation and distribution of prize money shall be final.
7. RACE DAY TICKETS
One of the principal benefits of membership is the opportunity to attend race meetings where Syndicate horses are declared to run.
Where Owners' and Trainers' badges are available, Always Trying Racing Syndicate will use every reasonable endeavour to obtain as many badges as possible.
As the number of badges provided by racecourses is outside the Syndicate's control, tickets cannot be guaranteed.
Where demand exceeds the number of available badges, tickets will be allocated using a fair ballot system.
The Syndicator's decision regarding ticket allocation shall be final.
Additional tickets may be requested from the racecourse whenever possible, although these cannot be guaranteed.
Owners' badges remain the property of the racecourse and may not be sold, transferred or exchanged without the Syndicate's permission.
8. STABLE VISITS
Where advertised, members will be invited to attend organised stable visits during the membership period.
Stable visits are arranged in conjunction with the horse's trainer and remain subject to trainer availability, horse welfare, weather conditions and operational requirements at the training yard.
If a member is unable to attend a scheduled stable visit, no refund, compensation or alternative visit is guaranteed.
Always Trying Racing Syndicate reserves the right to alter, postpone or cancel any stable visit where circumstances make this necessary.
Suitable footwear must be worn during stable visits and members attend entirely at their own risk.
9. HORSE RETIREMENT, SALE OR TRANSFER
Horse racing is an ever-changing sport and circumstances may arise where a horse is retired, sold, transferred, injured or otherwise leaves the Syndicate.
Where a horse is retired or sold with more than six months remaining on an active membership, Always Trying Racing Syndicate may, at its absolute discretion, transfer members to another suitable horse for the remainder of their membership.
Where six months or less remain on the membership at the time the horse leaves the Syndicate, the membership will normally continue until the end of its current term without transfer.
No guarantee can be given that a replacement horse will always be available.
The Syndicate reserves the right to make the final decision regarding any replacement horse or transfer arrangements.
10. MEMBER CONDUCT
Always Trying Racing Syndicate prides itself on maintaining excellent relationships with trainers, owners, racecourses and fellow members.
Members are expected to behave respectfully and courteously at all times.
Members must not contact trainers directly regarding the management, training or racing of any Syndicate horse unless specifically authorised by the Syndicator.
All enquiries should be directed to Neville King or an authorised representative of Always Trying Racing Syndicate.
Any member whose behaviour is considered abusive, threatening, offensive, disruptive or damaging to the reputation of the Syndicate may have their membership terminated without refund.
The Syndicator's decision regarding member conduct shall be final.
11. CANCELLATIONS & DEFAULT
Annual Memberships
Annual Memberships are sold as a fixed-term membership and are non-refundable once payment has been received.
Membership benefits remain valid for the published membership period unless terminated under these Terms & Conditions.
Monthly Lease Share Memberships
Members may cancel their monthly Lease Share Membership at any time.
Cancellation will take effect from the next scheduled payment date unless otherwise agreed by the Syndicate.
Once a membership has been cancelled, the member immediately loses all future membership benefits associated with that horse, including but not limited to:

Eligibility for future prize money.

Invitations to race days.

Stable visits.

Member-exclusive updates.

Any other benefits advertised for that membership.
No refunds will be made for partial months already paid.
Always Trying Racing Syndicate reserves the right to cancel any membership where payments are missed or where these Terms & Conditions have been breached.
12. LIMITATION OF LIABILITY
Horse racing is an unpredictable sport involving inherent risks.
Whilst Always Trying Racing Syndicate will always act honestly, professionally and in the best interests of both the horses and its members, no guarantee can be given regarding:

A horse's future performance.

Fitness or soundness.

Race entries.

Race results.
-
Prize money.
-
Future value.
-
Length of racing career.
Membership should never be regarded as an investment and members should not expect to recover the cost of their subscription.
Always Trying Racing Syndicate shall not be liable for any indirect or consequential loss arising from participation in the Syndicate.
13. DATA PROTECTION
Always Trying Racing Syndicate will collect and process personal information only for the purposes of administering memberships and communicating with members.
Personal information will never be sold or knowingly shared with third parties except where necessary for the operation of the Syndicate or where required by law.
Members may request access to their personal information or request that it be corrected at any time.

14. INTELLECTUAL PROPERTY
All photographs, videos, logos, branding, website content, social media content and written material produced by Always Trying Racing Syndicate remain the intellectual property of the Syndicate unless otherwise stated.
No material may be copied, reproduced or used commercially without prior written permission.
Whilst Always Trying Racing Syndicate endeavours to ensure all information published on its website is accurate, race entries, declarations, timings and horse information may change without notice.
15. GOVERNING LAW
These Membership Terms & Conditions shall be governed by and interpreted in accordance with the laws of England and Wales.
Any dispute arising in connection with these Terms & Conditions shall be subject to the exclusive jurisdiction of the Courts of England and Wales.

17. HORSE WELFARE
The welfare of every horse will always take priority over racing, financial considerations or member expectations.
Decisions regarding veterinary treatment, race entries, rest periods, rehabilitation, retirement or sale will always be made in consultation with the trainer and veterinary professionals where appropriate.
Members acknowledge that racing plans may change at short notice where this is considered to be in the best interests of the horse.
18. PHOTOGRAPHY & MEDIA
Members attending race meetings or stable visits may occasionally appear in photographs or videos used by Always Trying Racing Syndicate for promotional purposes.
ACCEPTANCE OF THESE TERMS
By purchasing, renewing or continuing your membership with Always Trying Racing Syndicate, you confirm that you have read, understood and agree to be bound by these Membership Terms & Conditions.
These Terms & Conditions may be updated from time to time to reflect changes in legislation, membership structure or the operation of the Syndicate.
The latest version will always be published on the Always Trying Racing Syndicate website.
